何か困ったとき、相談するのは日常的にかかわる身近な地域日本語教室や子ども食堂など地域における活動の現場です。相談を受けた側から「普段目にすることばだけれど、自分も実はよくわかっていないこともある」という声をよく耳にします。そこで、外国人相談事業や地域日本語教育支援を行ってきたCINGAが、日本の制度やことばについて知ることができる動画コンテンツを作成しました。

請負って何ですか。

会社などから注文を受けて、その仕事を完成して報酬をもらう人の働き方です。
「業務委託」とも言います。
会社の指揮命令は受けず、自分のやり方で働き、もらうお金は給料ではありません。
このような働き方をする人は「労働者」ではなく、「個人事業主」です。
個人事業主には、労働基準法など働く人を守る法律は、原則として、あてはまりません。
ただし、「請負」「業務委託」の契約で仕事をしていても、注文者の指揮命令を受けるなど実際の働き方が「労働者」であると判断されれば、「労働者」としての保護を受けることができます。

It is a form of work where a person receives an order from a company, etc., completes the assignments, and receives remuneration.
It is also called subcontracting.
You do not work under the instructions and control from the company but work in your own way, and the money you receive is not a salary.
A person who works this way is not a worker but a sole proprietor.
In principle, the laws that protect workers, such as the Labor Standards Law, do not apply to sole proprietors
However, even when you work under the terms of a contract for work or subcontracting, if you are judged as a worker because you are under the instruction and control of the client in the actual working style, you can receive protection as a worker.
